1. Introduction
DAM Games Company (“DAM Games”, “we”, “our” or “us”) is an independent game development studio that develops and publishes mobile games and may develop games for other platforms in the future.
This Privacy Policy explains how information may be collected, used, stored, disclosed and protected when you:
- Visit our official website.
- Download, install or play our mobile games.
- Interact with advertisements or in-app purchase features within our games.
- Contact us for support or other enquiries.
This Privacy Policy applies to our website and the games published by DAM Games Company that link to or refer to this Policy. A particular game may have additional privacy disclosures where necessary.
We aim to collect only the information reasonably necessary to operate, maintain, improve and support our services.
By using our website or games, you acknowledge this Privacy Policy. Where consent is required by applicable law, we will obtain that consent through an appropriate process. Simply using a game does not replace consent where consent is legally required.
2. Scope of this Policy
This Policy covers two categories of services.
2.1 Website
Our official website may be used to provide information about our studio, games, updates, support and contact details.
Our website is hosted using Firebase Hosting, a Google service. Depending on the hosting configuration and services enabled, technical information may be processed to deliver website content, maintain security, prevent abuse and diagnose technical problems.
Our website loads its fonts from Google Fonts. When a page loads, your browser connects to Google's servers, which receive your IP address and basic browser information.
Messages sent through the contact form on our website are delivered by Formspree, a form-processing service. When you submit the form, Formspree receives the details you enter (your name, email address, chosen topic and message) together with technical information such as your IP address, and forwards your message to our studio email inbox. We use these details only to read and reply to your message. Formspree processes this information under its own privacy policy.
2.2 Mobile games
Our mobile games are distributed or intended to be distributed through Google Play and potentially other platforms.
Our current games do not require users to create an account and do not use cloud-based game saves. Unless a particular game introduces these features, gameplay progression is kept locally on the user's device.
Individual games may use advertising, analytics, crash reporting or other third-party services when these services are integrated and enabled. The applicable disclosures will be updated to reflect the actual features and integrations of each published game.
3. Information we may collect
The information processed depends on the service you use, the game you play, the device settings and the third-party services integrated into that service.
3.1 Information you provide directly
We may receive information you voluntarily provide when contacting us, including:
- Your email address.
- Your name or preferred name, if provided.
- The content of your enquiry or support request.
- Screenshots, diagnostic information or other attachments you voluntarily submit.
- Other information reasonably necessary to respond to your enquiry.
Please do not send passwords, payment card details or other sensitive information.
We do not currently require users to create an account to play our games. If account-based features are introduced in the future, this Policy will be updated as appropriate.
3.2 Technical and device information
Depending on the website configuration and the SDKs or services used by a particular game, the following information may be processed:
- IP address and network-related information.
- Device model and device type.
- Operating system and version.
- App version and technical configuration.
- Device identifiers or advertising identifiers, where applicable.
- Diagnostic information and error logs.
- Information about app launches, performance and technical events.
Not every category is necessarily collected by every DAM Games service. Actual collection depends on the configuration and behaviour of the relevant website, game and third-party SDKs.
3.3 Gameplay and usage information
Where analytics or similar functionality is enabled, we may process information such as:
- Game sessions and session duration.
- Level progression and gameplay events.
- Game performance and feature usage.
- In-game interactions and settings.
- Technical errors and crashes.
- Advertising interaction or performance measurements, where applicable.
This information may be used to understand gameplay performance, identify defects, improve game balance and enhance the player experience.
We do not currently offer cloud-based game saves. Any future online progression, leaderboard, multiplayer or account feature will be assessed and disclosed before or when it is introduced.
3.4 Advertising information
Google AdMob is a planned advertising service for our games. If a game integrates Google AdMob or another advertising service, that service may process information needed to request, deliver, measure and protect advertisements.
Depending on the SDK, configuration and applicable permissions or consent choices, this may include:
- Advertising identifiers.
- IP address and general device information.
- Ad impressions, clicks and interaction events.
- Advertising and conversion measurements.
- Information used to detect invalid traffic or advertising fraud.
- Information used to determine whether personalised or non-personalised advertising can be served.
Advertising providers may collect or receive information directly through their SDKs. Their processing is also governed by their own policies and applicable requirements.
Where the law requires consent, a game will ask for your consent before personalised advertising is used, and you can change your choice at any time. See Section 11.1.
3.5 Analytics and crash reporting
We may in future use analytics and crash-reporting services, such as Firebase Analytics and Firebase Crashlytics. At the time of this update they are not integrated in our games; this section will apply to a game once they are added to it.
Depending on the services enabled, these tools may process app-instance identifiers, usage events, device information, crash reports, diagnostic details and related technical information. We use such information to understand how our games perform, identify crashes, troubleshoot issues and improve stability.
3.6 Information from third-party platforms
When you download a game or make an in-app purchase through Google Play or another platform, that platform may process information under its own privacy policy and terms. In-app purchases are processed by the platform; we do not receive your payment card details.
We may receive limited information necessary to support distribution, purchases, refunds, service administration or other platform functionality, depending on the features used and information made available to us. We do not automatically receive all personal information held by the platform.
4. How we use information
Depending on the service and features involved, we may use information for the following purposes.
4.1 Providing and operating our services
- Delivering and maintaining our website and games.
- Supporting gameplay and game functionality.
- Responding to enquiries and support requests.
- Maintaining compatibility with supported devices and platforms.
- Managing purchases or other features where applicable.
4.2 Improving games and performance
- Diagnosing crashes and technical errors.
- Analysing gameplay performance and feature usage.
- Improving loading times, stability and compatibility.
- Identifying defects and balancing gameplay.
- Developing and evaluating new game features.
4.3 Advertising and monetisation
Where advertising is enabled, information may be processed to serve advertisements, measure advertising performance, prevent invalid activity and support monetisation.
Personalised advertising and related data processing will be subject to applicable legal requirements, platform policies, SDK settings and consent choices, as described in Section 11.1.
4.4 Security and fraud prevention
We may use relevant information to detect suspicious activity, protect our services, prevent abuse, investigate technical incidents and enforce applicable terms.
4.5 Legal and administrative purposes
We may process information where necessary to comply with applicable laws, respond to lawful requests, establish or defend legal claims, or protect our rights and the safety of users.
We will not use personal information for materially different purposes without providing additional information or obtaining consent where required.
5. Cookies and similar technologies
The pages of our website do not set their own cookies. Our hosting and security provider or other website services may use cookies, local storage, logs or similar technologies for functions such as:
- Website delivery and security.
- Session management, where applicable.
- Preference storage.
- Performance measurement and diagnostics.
- Advertising or analytics, if enabled.
The technologies used depend on the actual website configuration and services enabled. You can manage cookies through your browser settings. Disabling certain cookies may affect some website functions.
Where applicable law requires consent before non-essential cookies or similar technologies are used, the relevant consent mechanism will be implemented.
Mobile games may use SDKs, device identifiers or local storage on the device rather than traditional website cookies. The applicable mobile data practices are described in the relevant sections of this Policy.
6. Advertising and third-party services
Our website and games may integrate services provided by third parties, including:
- Google Play and related platform services, including Google Play Billing for in-app purchases.
- Google AdMob or other advertising providers, where enabled.
- Firebase Analytics or Firebase Crashlytics, where enabled.
- Website hosting and security providers.
- Google Fonts, used to display the website's fonts.
- Formspree, which delivers messages sent through the website's contact form to our studio email inbox.
- Other technical service providers required for a particular game.
These providers may process information to deliver their services, subject to their own terms, privacy policies, technical configurations and applicable legal requirements. We seek to use third-party services appropriately and to review their data practices before integration.
We do not control all data processing carried out independently by third-party providers. Users should review the relevant provider's privacy policy for further details, for example the Google Privacy Policy and the Formspree Privacy Policy.
References to a service in this Policy do not mean that it is enabled in every game.
7. Sharing and disclosure of information
We do not disclose personal information indiscriminately. Depending on the service and circumstances, information may be disclosed to the following categories of recipients.
7.1 Service providers
We may share or permit access to information by providers that support website hosting, security, analytics, crash reporting, advertising, customer support or other necessary technical functions.
7.2 Advertising and analytics partners
Where the relevant services are enabled, advertising and analytics providers may collect or receive information through their SDKs or technologies for the purposes described in this Policy.
7.3 Distribution and payment platforms
Google Play or another distribution platform may process purchase, distribution or service-related information. Payment transactions are handled through the applicable platform or payment provider, where supported.
7.4 Legal requirements and protection
We may disclose information where reasonably necessary to comply with applicable law, respond to valid legal requests, protect users, investigate fraud or defend our legal rights.
7.5 Business transfers
If DAM Games Company undergoes a merger, restructuring, sale or transfer of relevant business assets, information may be transferred as part of that transaction, subject to applicable legal requirements and appropriate safeguards.
8. Data retention and deletion
We retain information only for as long as reasonably necessary for the purposes described in this Policy, subject to applicable legal requirements. Retention periods may differ depending on the type of information, the service provider, technical requirements, security needs and legal obligations.
- Support enquiries: retained for the period necessary to respond to the enquiry and maintain appropriate support records.
- Contact form messages: kept in our email inbox for as long as needed to respond and keep appropriate records. Formspree also keeps a copy of each submission according to its own retention practices.
- Website technical logs: retained according to the hosting and security configuration and the applicable provider's retention settings.
- Analytics and crash reports: retained according to the relevant SDK configuration and provider settings.
- Advertising information: retained or managed according to the advertising provider's applicable policies and settings.
- Locally stored game data: remains on the device until deleted by the user, removed by clearing the app's data or uninstalling the game, subject to the platform and operating system.
Because our games do not currently use accounts or cloud saves, there is generally no DAM Games account to delete. However, information processed by third-party SDKs or providers may be subject to their own retention and deletion procedures.
If account creation, cloud saves or other online features are introduced, the applicable retention and deletion arrangements will be updated.
You may contact us using the details in Section 15 to submit a request concerning personal information that we control. We will respond in accordance with applicable law.
9. Data security
We take reasonable technical and organisational measures appropriate to the information processed to protect it against unauthorised access, disclosure, alteration, loss or misuse. Depending on the service, safeguards may include access controls, appropriate service configurations, security updates, restricted access and the use of reputable service providers.
No website, application, storage system or internet transmission can be guaranteed to be completely secure. We therefore cannot promise absolute security.
Where a security incident triggers a legal notification obligation, we will take the steps required by applicable law.
10. Children's privacy
DAM Games Company's games are designed for a general audience of players aged 13 and over. They are not intended for, or specifically directed to, children under 13 years of age, and their store listings target an audience of 13 and over.
We do not knowingly serve personalised advertising to users we know to be under 13.
We do not knowingly collect personal information from children under 13 in circumstances where such collection is prohibited by applicable law. We expect users to comply with the applicable age requirements and the terms of the platform through which our games are distributed.
If you believe that a child has provided personal information to DAM Games in circumstances that are not permitted, please contact us using the details in Section 15.
11. Your privacy rights and choices
Depending on your location and applicable law, you may have rights concerning personal information, including rights to:
- Request information about personal data processing.
- Request access to personal information.
- Request correction of inaccurate or incomplete information.
- Request deletion or erasure where applicable.
- Withdraw consent where processing is based on consent.
- Object to or restrict certain processing where applicable.
- Exercise applicable rights relating to data portability or complaints.
The availability and scope of these rights depend on applicable law and any relevant exceptions. You may contact us to exercise a right or raise a privacy concern. We may request reasonable information to verify your identity and protect against unauthorised requests.
Where processing is carried out directly by a third-party provider, you may also need to contact that provider to exercise rights relating to information it independently controls.
11.1 Advertising consent and choices
When a game shows advertising through Google AdMob, it uses Google's User Messaging Platform (UMP), or another consent tool certified under the applicable framework, to collect and store your choices.
Users in the European Economic Area, the United Kingdom and Switzerland. Before personalised advertising is used, the game shows a consent message. It explains how the advertising partners use information, including device identifiers and similar technologies, and lets you:
- Consent to personalised advertising.
- Decline personalised advertising.
- Choose which purposes and advertising partners you allow, through the message's options.
If you decline, the game shows non-personalised or limited advertising instead. These ads are not based on your past activity, but advertising partners may still process limited information, such as an identifier or IP address, to deliver ads, limit how often you see the same ad, produce aggregated reports and detect fraud. Declining does not stop you from playing the game.
Users in US states with consumer privacy laws. Where these laws apply, the game lets you opt out of the sale or sharing of personal information for targeted advertising, through the privacy options described below.
Changing your choice. You can review, change or withdraw your consent at any time through the privacy options in the game's Settings menu. Withdrawing consent applies from that point on; it does not affect processing that took place before.
Device settings. On Android you can reset or delete your advertising ID, or opt out of personalised ads, in your device's settings (usually Settings › Privacy › Ads, or Settings › Google › Ads). If the advertising ID is deleted, advertising partners can no longer use it to personalise ads.
Available choices depend on your device, location, the advertising SDK and applicable law. For more about how Google uses information from apps that use its services, see How Google uses information from sites or apps that use its services.
12. International data processing
Our service providers may process information in countries other than the country in which a user resides. The locations in which information is processed depend on the providers and services actually used by the relevant website or game.
13. Third-party links and services
Our website or games may contain links to third-party websites, platforms or services. We are not responsible for the privacy practices of services that we do not operate. Accessing those services is subject to their own terms and privacy policies.
We encourage users to review the relevant privacy information before providing personal information to a third party.
14. Changes to this Privacy Policy
We may update this Privacy Policy to reflect changes in our games, website, technical integrations, business practices, applicable law or platform requirements.
The “Last updated” date at the top of this Policy will be revised when changes are made. Where a change is material or additional consent or notice is required, we will take appropriate steps to inform users.
We encourage users to review this Policy periodically. The version published on this page is the current version for the services covered by it.
15. Contact us
For questions, complaints or requests concerning this Privacy Policy or the handling of personal information, please send us a message through our Contact page.
We will review and respond to requests within the time required by applicable law.
